1. Definitions

In these Terms and Conditions:

• "Suan Sook" / "we" / "us" refers to the operator of the Suan Sook residential retreat at 23/7 Moo 5, Khao Tao, Hua Hin, Prachuap Khiri Khan 77110, Thailand
• "Resident" / "you" refers to any individual who has entered into a residential or programme arrangement with Suan Sook
• "Services" refers to all residential options, programmes, and associated services offered by Suan Sook
• "Agreement" refers to the residency or programme arrangement entered into between Suan Sook and the Resident
• "Website" refers to the website operated at https://suansookes

2. Acceptance of Terms

By enquiring about, booking, or using any of Suan Sook's services, you confirm that you have read, understood, and agree to these Terms and Conditions. If you do not agree, please refrain from entering into an arrangement with us.

These terms apply to persons aged 18 years and above. We do not provide services to minors.

3. Service Description

Suan Sook operates as a non-medical senior residential retreat. Our services include residential accommodation, meals, housekeeping, and optional cultural enrichment programming. We do not provide medical care, nursing services, or clinical support of any kind.

Services are available to residents living on-site in Hua Hin, Thailand. We do not offer remote services. Availability of specific arrangements is subject to capacity and suitability assessment.

4. Resident Responsibilities

As a resident, you agree to:

• Treat staff and fellow residents with courtesy and respect at all times
• Comply with house rules provided at the time of arrival
• Inform Suan Sook promptly of any changes to your health, emergency contacts, or circumstances that may affect your arrangements
• Not engage in conduct that causes disruption, distress, or harm to others on the property
• Ensure that your visa and immigration status remains valid throughout your stay — Suan Sook cannot provide visa assistance
• Not bring onto the property any substance, item, or person that would be prohibited under Thai law

5. Arrangements and Pricing

Seaside Comfort Residence: ฿10,200 per month, available on a monthly rolling basis with a trial period as described in the residency agreement.

Cultural Enrichment Package: ฿22,000 per month, available as a standalone programme membership or in addition to a residential arrangement.

Premium Villa Residence: ฿41,500 per month, subject to a minimum term of three months as detailed in the villa residency agreement.

All prices are quoted in Thai Baht (฿) and include the services described in the individual arrangement. Prices are subject to periodic review. You will be given at least 60 days' written notice of any price change affecting your current arrangement.

6. Payment Terms

Payment is due in advance on the first day of each calendar month, or as otherwise agreed in your arrangement. We accept bank transfer. Details are provided in the residency agreement.

Late payment may result in suspension of services after 10 days. Persistent non-payment may result in termination of the arrangement. Outstanding amounts remain due regardless of termination.

7. Cancellation and Refunds

For the Comfort Residence and Cultural Package: you may give 30 days' written notice to end your monthly arrangement. Payments for the current month are non-refundable. Payments for future months already paid will be refunded on a pro-rata basis.

For the Premium Villa Residence: the three-month minimum term is binding. Early departure within this period does not reduce the financial obligation for that term. After the minimum term, the standard 30-day notice period applies.

We reserve the right to terminate any arrangement immediately if a resident's conduct presents a risk to the safety or wellbeing of others. In such cases, a pro-rata refund of unused paid time may be considered at our discretion.

8. Intellectual Property

All content on the Suan Sook website — including text, images, and design — is owned by or licensed to Suan Sook. You may not reproduce, adapt, or distribute this content without our prior written consent.

9. Disclaimers

Suan Sook is a residential retreat only. We do not make representations about health outcomes, personal development, or any results beyond the delivery of the residential services described. Our services are provided in good faith and with care, but we cannot predict or promise individual outcomes.

Our website content is provided for informational purposes. While we take care to keep it accurate, we do not warrant that it is complete or error-free at all times.

10. Limitation of Liability

To the fullest extent permitted by Thai law, Suan Sook's liability to any resident or enquirer is limited to the fees paid by that person in the three months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or economic losses.

This limitation does not apply to liability for death or personal injury resulting from our negligence, or to any liability that cannot be excluded under applicable law.

11. Termination

Either party may terminate a monthly arrangement by giving 30 days' written notice. Suan Sook may terminate with immediate effect for serious breach of these terms or house rules. The three-month minimum term of the Premium Villa arrangement is not subject to early termination by the resident without financial consequence.

12. Governing Law and Disputes

These Terms and Conditions are governed by the laws of the Kingdom of Thailand. In the event of a dispute, we will first attempt to resolve matters informally through direct communication. If informal resolution is not possible, disputes will be subject to the jurisdiction of the courts of Prachuap Khiri Khan Province, Thailand.

13. General Provisions

If any clause in these terms is found to be unenforceable, the remaining clauses continue in full effect. These terms constitute the entire agreement between you and Suan Sook regarding the matters covered here and supersede any prior discussions. Failure to enforce any term does not constitute a waiver of that term.

14. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated at least 30 days in advance to current residents. Continued use of our services after the effective date constitutes acceptance of the updated terms. The current version is always available on our website.
